These Terms govern access to The Crunch List website, directory, business accounts, annual paid memberships, community recommendations, Crunch Guides, Crunchy Deals, external merchandise links, and related services.
1. Agreement and Operator
These Terms of Service are a binding agreement between you and The Crunch List ("The Crunch List," "we," "us," or "our"). By accessing or using thecrunchlist.com or related services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
If you use the service for a business or organization, you represent that you have authority to bind it to these Terms. In that case, "you" includes both you and that business or organization.
2. Eligibility and Accounts
You must be legally capable of entering a contract to create a business account or purchase a membership. You must provide accurate information and keep it reasonably current. You are responsible for activity under your account and for protecting login credentials. Notify us promptly at admin@thecrunchlist.com if you suspect unauthorized access.
You may not impersonate another person or business, claim a listing without authority, share an account in a manner that compromises security, or use false information to obtain access or benefits.
3. The Service
The Crunch List provides an online directory and community resource. Features may allow users to:
- Search and view business listings, categories, and descriptive attributes.
- Recommend businesses or submit corrections.
- Create, claim, and manage eligible business listings.
- Purchase a paid business membership with the features shown for that plan.
- Submit Crunchy Deals or other promotions.
- Read or contribute Crunch Guides and other editorial content.
- Subscribe to communications and follow links to independent businesses or external storefronts.
We may add, change, suspend, or discontinue features. If a change materially affects a paid membership during its current paid period, applicable law and the specific offer terms will control any remedy.
4. Business Listings and Directory Information
Listing information may come from business owners, community members, contributors, or public sources. We may review, organize, edit for style or clarity, correct, decline, suspend, or remove a listing. We do not promise that every recommended business will be listed or that a listing will remain published.
Directory information can become outdated. The Crunch List does not guarantee the accuracy, completeness, availability, licensing, safety, quality, legality, or suitability of a listed business, product, service, price, promotion, ingredient, or practice. Users should confirm material information directly with the business before relying on it.
5. Categories, Attributes and Verification
The directory may use categories or descriptions such as organic, regenerative, grass-fed, pasture-raised, seed oil free, low-tox, fragrance free, holistic, gluten-free options, locally produced, or similar terms. Unless a listing expressly identifies an independent certification, these descriptions are informational and may be based on submissions or public information. They do not represent laboratory testing, certification by The Crunch List, or verification of every product or practice.
A Community Recommended designation means that a community member suggested the business. It is not an endorsement or proof that the business has reviewed its listing. A Business Confirmed designation means that a person representing the business confirmed authority over or certain information in the listing. It is not a comprehensive audit, certification, or guarantee.
Paid membership does not by itself establish verification, endorsement, professional competence, regulatory compliance, or eligibility for an editorial recommendation.
6. Business Owner Responsibilities
A person who submits, claims, or manages a business listing represents and warrants that:
- The person is authorized to act for the business.
- Submitted information is accurate to the best of the person's knowledge and is not materially misleading.
- The person has all rights and permissions needed to submit names, logos, photographs, descriptions, promotions, and other materials.
- The business and its offers comply with applicable laws, licenses, permits, advertising rules, and professional requirements.
- The person will make reasonable efforts to correct material changes or inaccuracies.
7. User and Business Content
You retain ownership of content you submit. You grant The Crunch List a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt for layout or accessibility, publish, display, distribute, and promote that content as reasonably necessary to operate and market The Crunch List. This license lasts while the content is used by the service and for a reasonable archival, backup, or promotional wind-down period, except that legal and transaction records may be retained as required.
You represent that your content does not infringe intellectual property, privacy, publicity, or other rights; contain unlawful, deceptive, defamatory, or malicious material; or introduce malware. We may remove or restrict content that we reasonably believe violates these Terms or creates legal, safety, or integrity concerns.
Suggestions and feedback may be used without restriction or compensation, provided we do not identify you publicly as the source without permission.
8. Crunch Guides and Contributors
Crunch Guides and other educational or editorial materials may be created by The Crunch List or outside contributors. Contributor selection, editing, placement, publication, and removal remain editorial decisions unless a separate written agreement states otherwise.
Contributors must submit original or properly licensed material, disclose material business relationships or conflicts when relevant, support factual claims, and avoid medical, legal, financial, or other professional advice unless appropriately qualified and the content is reviewed for that purpose. A byline or contributor profile does not mean The Crunch List endorses every view expressed.
Unless a separate signed contributor agreement provides compensation or different rights, submission does not create a right to payment, ongoing publication, traffic, referrals, or future assignments.
9. Crunchy Deals and Promotions
Participating businesses are responsible for the accuracy, availability, eligibility rules, expiration dates, exclusions, inventory, fulfillment, and legal compliance of Crunchy Deals and other promotions. Users should confirm the terms with the business before purchase or travel.
The Crunch List may display, edit for clarity, decline, suspend, or remove a deal. Unless The Crunch List expressly identifies itself as the seller, the transaction is between the user and the participating business. The Crunch List does not guarantee availability, savings, redemption, product quality, or dispute resolution. Paid promotional placement will be identified when required by law.
10. Free and Paid Memberships
The Crunch List may offer a Free tier and paid annual plans, including plans identified as Premium or Featured. The features, price, and eligibility rules shown at checkout or in the applicable offer are part of these Terms. Paid features may include additional photographs, Crunchy Deals, priority or enhanced placement, analytics, or other features shown for the plan.
Membership purchases do not guarantee website traffic, customer inquiries, sales, revenue, profit, search-engine placement, or any other business result. Editorial decisions remain separate from paid membership unless a placement is expressly included in the plan and described as promotional.
11. Annual Renewal and Cancellation
11.1 Automatic Annual Renewal
Paid memberships renew automatically every 12 months until canceled. By purchasing a paid membership and affirmatively agreeing to recurring billing, you authorize The Crunch List, through Stripe, to charge the payment method associated with your subscription at the annual rate disclosed at checkout and at renewal, subject to applicable law and any valid promotional terms.
11.2 Advance Renewal Reminder
The Crunch List sends an advance renewal reminder before the annual renewal charge. You are responsible for keeping your account email address current. A reminder does not extend the deadline to cancel or alter the scheduled renewal date unless the message or applicable law expressly says otherwise.
11.3 How to Cancel
You may cancel future automatic renewal at any time:
- Sign in at https://thecrunchlist.com.
- Open the business dashboard at /dashboard.
- Select Manage Billing.
- Follow the cancellation instructions in the Stripe Customer Portal.
Cancellation stops future renewal charges but does not end the current paid membership immediately. Paid benefits remain active through the end of the paid billing period. When that period ends, the listing automatically downgrades to the Free tier, and paid-only features end. The basic listing may remain active subject to these Terms and directory policies.
11.4 Failed or Disputed Payments
If a payment fails, is reversed, or is disputed, we or Stripe may retry the payment, ask you to update the payment method, limit paid features, or end the paid membership, subject to applicable law and Stripe's processes. Contact us promptly if you believe a charge is incorrect.
12. Fees, Taxes and Refunds
Prices and billing frequency are displayed before purchase. You are responsible for applicable taxes unless the checkout states that they are included. Except as required by law or expressly stated in the applicable checkout or written offer, annual membership fees are generally nonrefundable after the paid period begins. Canceling renewal does not automatically create a prorated refund for the unused portion of the current period.
Nothing in these Terms limits a refund, cancellation, or other right that cannot lawfully be waived. We may choose to issue a refund or credit in a particular case, but doing so does not require us to provide the same remedy in another case.
13. Founding Rates, Promotions and Price Changes
A "founding," introductory, discounted, or promotional rate applies only if it is expressly offered to you. The offer and checkout disclosure control its amount, eligibility, duration, renewal price, and conditions. The words "founding rate" alone do not promise a lifetime price, permanent discount, or unchangeable benefits.
If an offer expressly promises a rate for a defined period or while stated conditions remain satisfied, we will apply that promise according to its written terms. Otherwise, renewal occurs at the price disclosed for the upcoming renewal, subject to any notice and consent required by law. The advance renewal reminder does not, by itself, create a separate price guarantee.
14. Merchandise and the External Printify Storefront
The Crunch List may link to merchandise offered through an external storefront using Printify. Unless the checkout expressly states otherwise, the external merchant or storefront provider handles checkout, payment, production, fulfillment, shipping, returns, exchanges, and customer-service terms for merchandise.
Merchandise purchases are governed by the terms, policies, prices, and disclosures shown in that external checkout. The Crunch List is not responsible for an external provider's availability, processing times, shipping delays, print variations, return decisions, or data practices, except to the extent applicable law provides otherwise or The Crunch List is expressly identified as the seller.
15. Health, Food and Educational Disclaimer
The Crunch List provides directory, community, and educational information. It does not provide medical, nutritional, dietary, veterinary, legal, financial, or other professional advice. Content about food, ingredients, wellness, environmental practices, or lifestyle choices is general information and may not fit your circumstances.
Always verify ingredients, allergen handling, cross-contact procedures, sourcing claims, preparation methods, recalls, qualifications, and safety practices directly with the business or product provider. "Gluten-free," "seed oil free," "organic," and similar descriptions may have different meanings or may change. People with allergies, medical conditions, pregnancy, or other health concerns should consult an appropriate professional and should not rely on the directory as a substitute for individualized advice.
The Crunch List does not inspect kitchens, test products, diagnose conditions, prescribe treatment, or guarantee that a food, product, service, provider, or recommendation is safe or suitable.
16. External Businesses, Services and Links
Listed businesses and linked websites are independent from The Crunch List unless expressly stated otherwise. The Crunch List is not a party to transactions between users and those businesses and does not control their products, services, prices, hours, policies, qualifications, security, or privacy practices.
A link, listing, Community Recommended designation, Business Confirmed designation, or paid placement does not constitute an endorsement, certification, partnership, agency, franchise, or guarantee.
17. Acceptable Use
You may not:
- Use the service for unlawful, fraudulent, deceptive, harassing, defamatory, or abusive conduct.
- Submit false business ownership claims, misleading promotions, fabricated recommendations, or content that infringes another person's rights.
- Scrape, crawl, harvest, copy, or use directory content at scale except through a method we expressly authorize or as permitted by law.
- Interfere with security, authentication, accounts, networks, or normal operation; probe for vulnerabilities; or introduce malicious code.
- Circumvent access limits, attempt unauthorized access, or use the service to send spam.
- Use The Crunch List names, branding, or content in a way that falsely suggests endorsement or affiliation.
18. Our Intellectual Property
The Crunch List website, branding, design, original text, selection and arrangement of directory content, and other materials we create are protected by intellectual property laws. These Terms permit personal, lawful use of the service. They do not transfer ownership or grant a right to reproduce, distribute, sell, sublicense, or create competing databases from our materials except with written permission or as permitted by law.
Business names, logos, photographs, and contributor materials may belong to their respective owners and are used under permission, license, submission terms, or applicable law.
19. Copyright and Rights Complaints
If you believe content on the service infringes your copyright or another right, contact admin@thecrunchlist.com with enough detail to identify the work, the challenged material, its location, your contact information, and the basis for your claim. We may request additional information and may remove or restrict material while reviewing a complaint. This contact method is not a substitute for any formal statutory notice process that may apply.
20. Suspension and Termination
You may stop using the service at any time. Business members may cancel future renewal as described in Section 11. We may suspend, restrict, or terminate an account, listing, submission, or access when reasonably necessary to address a violation of these Terms, fraud, nonpayment, security risk, legal requirement, harm to users or businesses, or threats to the integrity of the directory.
Provisions that by their nature should survive will survive, including payment obligations already incurred, licenses needed for archival or legal purposes, intellectual property terms, disclaimers, limits of liability, indemnity, dispute terms, and miscellaneous provisions.
21. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL DIRECTORY, EDITORIAL, PROMOTIONAL, AND THIRD-PARTY INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE.” THE CRUNCH LIST DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR CURRENT, OR THAT LISTINGS, DEALS, GUIDES, CONTRIBUTORS, BUSINESSES, PRODUCTS, SERVICES, OR RESULTS WILL BE ACCURATE, AVAILABLE, SAFE, LAWFUL, OR SUITABLE. THESE DISCLAIMERS DO NOT EXCLUDE WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CRUNCH LIST AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE, A LISTED BUSINESS, A CONTRIBUTION, A DEAL, AN EXTERNAL STOREFRONT, OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE CRUNCH LIST FOR ALL CLAIMS ARISING FROM OR RELATED TO A PAID MEMBERSHIP WILL NOT EXCEED THE AMOUNT YOU PAID TO THE CRUNCH LIST FOR THAT MEMBERSHIP DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. FOR CLAIMS UNRELATED TO A PAID MEMBERSHIP, TOTAL LIABILITY WILL NOT EXCEED 100 UNITED STATES DOLLARS.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the extent permitted by law.
23. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless The Crunch List and its owners, officers, employees, contractors, and agents from third-party claims, damages, losses, liabilities, and reasonable costs arising from your content, business listing, promotion, products or services, violation of these Terms, or infringement of another person's rights. This obligation does not apply to the extent a claim results from The Crunch List's own unlawful conduct.
24. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent the law where you live requires otherwise. Any court proceeding must be brought in a state or federal court with jurisdiction over the legal operator's principal place of business, unless applicable law gives you the right to bring it elsewhere.
Before filing a claim, you and The Crunch List agree to make a good-faith effort to resolve the dispute informally by written notice to the contact in Section 28. This informal process does not extend a legal deadline or prevent either party from seeking urgent relief. These Terms do not require arbitration and do not waive any right to participate in a class action.
25. Changes to the Service and These Terms
We may update these Terms as the service or law changes. The revised Terms will be posted with a new Last Updated date. We will provide additional notice or obtain consent when required by law. Changes apply prospectively from their stated effective date. Material changes to a current paid period will remain subject to applicable law and any express written offer terms.
26. Electronic Communications
You consent to receive agreements, notices, disclosures, and other communications electronically when legally permitted. Keep your email address current. Electronic delivery does not waive any right to paper notice that applicable law requires.
27. General Terms
These Terms, the Privacy Policy, and any plan or offer terms presented at checkout form the agreement governing the service. If a specific paid offer conflicts with these Terms, the specific offer controls for that subject. A separate signed agreement controls to the extent it expressly conflicts.
If a provision is unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without our consent. We may transfer these Terms in connection with a reorganization, sale, or transfer of the service, subject to applicable law. Headings are for convenience only.
